Orr argues that while cities may already have noise ordinances or require permits for parades, the bill addresses the growing trend of protestors targeting private homes, a practice highlighted by demonstrations outside Justice Brett Kavanaugh’s residence in 2022.

The bill’s proponents emphasize the potential dangers posed to homeowners and their families when faced with large gatherings of protestors outside their residences. Orr paints a vivid picture of the scenario, envisioning homeowners feeling threatened and intimidated by crowds, unsure of their safety and ability to access essential services like medical care.

However, critics of SB57, including Travis Jackson from Black Lives Matter Grass Roots, argue that the bill infringes on First Amendment rights, particularly for marginalized communities. Linda Coleman-Madison (D-Birmingham) express reservations about SB57, raising concerns about potential overreach by local governments and the need to balance free speech with community sensitivities. While acknowledging the importance of protecting homeowners’ privacy and peace, they advocate for measures that safeguard constitutional rights without stifling dissent.
